Terms of Service

Last updated: November 5, 2026

These Terms of Service ("Terms") govern your use of Image Describer, including its website, image analysis tools, and related account features (the "Service"). "Image Describer," "we," "us," and "our" refer to the operator of the Service. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service provides

Image Describer uses AI to turn submitted images into text. Available tasks include image descriptions, descriptions of visible people and objects, visual style analysis, text extraction (OCR), alt text, image-generation prompts, and answers to questions about an image. Generating a prompt does not itself generate or edit an image.

The public image describer is currently free and does not require an account. Availability depends on service capacity, supported file types, file-size limits, and other technical restrictions. Free access does not guarantee unlimited requests, uninterrupted availability, or a particular response time.

2. Eligibility and accounts

You must be at least 13 years old, meet any higher minimum age required where you live, and be legally able to agree to these Terms. If you are below the age of majority, a parent or legal guardian must authorize your use and accept these Terms on your behalf where required by law. If you use the Service for an organization, you confirm that you have authority to bind it.

If you create or use an account, provide accurate information, keep your sign-in credentials secure, and tell us promptly if you suspect unauthorized access. You are responsible for activity you authorize through your account. You may not impersonate another person or use another person's account without permission.

3. Your images, inputs, and permissions

You retain any ownership rights you have in images, instructions, questions, and other content you submit ("Inputs"). You are responsible for having the rights, permissions, and legal basis needed to submit those Inputs, including permission to process personal information about other people where required.

You give us a limited, non-exclusive license to receive, temporarily process, transform, and transmit your Inputs to our service providers as necessary to operate the Service, generate your requested results, maintain security, and comply with law. This license does not transfer ownership or authorize us to publish your images in a public gallery or use them in advertising without separate permission.

AI processing involves sending a processed image and relevant task inputs to an external AI provider. The public image description workflow does not save uploads or generated text to an account history. Our Privacy Policy explains data handling, including provider processing and retention. Do not submit confidential or sensitive information unless you are authorized to share it for that processing.

4. Generated text and your use of it

The text returned by the Service ("Outputs") is generated automatically and may be incomplete, inaccurate, biased, or unsuitable for your purpose. Outputs can misidentify objects, invent details, omit important context, or misread text. Descriptions of people do not establish identity or reliably determine personal characteristics. Generated alt text does not by itself establish that a website meets accessibility requirements.

Review and edit Outputs before publishing, relying on, or sharing them. Do not use the Service as the sole basis for medical, legal, financial, safety-critical, or other decisions with significant consequences for a person.

As between you and Image Describer, we do not claim ownership of your Outputs. To the extent we acquire transferable intellectual property rights in an Output, we assign those rights to you. You may use Outputs for personal or commercial purposes, subject to these Terms, applicable law, and the rights of others. This permission does not guarantee that an Output is copyrightable, unique, accurate, or free of third-party rights. Other users may receive similar text.

5. Acceptable use

You must not:

  • Submit content or use Outputs in violation of law, intellectual property rights, privacy rights, or other rights of a person.
  • Upload child sexual abuse material or use the Service to exploit children, facilitate violence, threaten people, harass, defraud, or distribute unlawful content.
  • Use the Service for unauthorized identification, surveillance, or sensitive profiling of people.
  • Upload malware, interfere with the Service, probe systems without authorization, or try to access another user's information.
  • Circumvent rate limits, security controls, or access restrictions, including by distributing requests across accounts or systems to evade limits.
  • Send automated requests that disrupt the Service or materially exceed its intended capacity without our permission.
  • Misrepresent Outputs as verified facts, professional advice, or content endorsed by Image Describer.

We may restrict requests or access reasonably necessary to address misuse, security risks, legal obligations, or service capacity.

6. Paid offerings, subscriptions, and credits

Using the free public image describer does not enroll you in a subscription. If you choose a paid offering, the price, currency, billing interval, included benefits, applicable taxes, and any credit or trial conditions will be presented before purchase. You authorize charges only for the paid offering you select.

Recurring subscriptions renew at the interval disclosed at checkout until canceled. Cancel through the billing portal available from your account, or contact [email protected] for help. Cancellation stops future renewals; the effective date and remaining access follow the terms shown for your purchase. Stopping use of the Service or deleting an account should not be relied on to cancel recurring billing: cancel the subscription separately.

Any credits or promotional allowances are usable only for eligible features, have no cash value, and are subject to the usage and expiration conditions disclosed when offered. They do not provide an ownership interest in the Service.

Unless the purchase terms say otherwise, payments are non-refundable, except where applicable law requires a refund, withdrawal right, or other remedy. Contact support if you believe a charge is incorrect or unauthorized. Nothing in these Terms limits mandatory consumer rights. We will provide advance notice of material changes to recurring prices and an opportunity to cancel before those changes apply, as required by law.

7. Our intellectual property and third-party services

The Service's software, design, branding, and materials supplied by us are owned by Image Describer or its licensors. You may use them only as needed to access and use the Service under these Terms. No ownership of the Service or its trademarks transfers to you.

The Service relies on third parties for functions such as AI processing, hosting, sign-in, and payments. Availability and results can be affected by those providers. When you use a third-party service directly or follow an external link, its own terms and privacy policy may apply. We are not responsible for external websites we do not operate.

If you voluntarily provide feedback about the Service, you allow us to use that feedback to improve our products without payment or attribution. This permission does not expand our rights to your uploaded images or personal information.

8. Availability and ending use

We may change features, apply usage limits, perform maintenance, or discontinue the Service. We may suspend or terminate access for a material violation of these Terms, a security threat, unlawful use, or a legal requirement. Where reasonably possible and appropriate, we will explain the reason and allow you to contact us about an error. We may act immediately where necessary to protect users or the Service.

You can stop using the Service at any time and delete an account through available settings or by contacting support. Save any Outputs you need: the public tool does not provide a persistent archive or recovery service. Termination does not remove payment obligations already incurred or rights and obligations that by their nature continue after termination. Any mandatory refund or other consumer remedy remains available.

9. Disclaimers

To the extent permitted by law, the Service and Outputs are provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not guarantee that the Service will meet every requirement or that every error can be corrected.

These exclusions do not remove warranties, guarantees, or remedies that cannot lawfully be excluded, including mandatory consumer protections.

10. Liability

To the extent permitted by law, Image Describer is not liable for indirect, incidental, special, or consequential losses, including loss of profits, business opportunities, goodwill, or data arising from use of the Service. Our total liability for claims relating to the Service is limited to the greater of USD 100 or the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any liability that applicable law does not allow us to exclude or limit. Nothing in these Terms reduces rights or remedies that you have under mandatory consumer law.

11. Disputes and applicable law

If you have a concern, contact [email protected] so we can try to resolve it. Contacting us does not prevent you from seeking a legal remedy or making a complaint to a competent authority.

Applicable law determines the law and courts governing a dispute. These Terms do not deprive consumers of the mandatory protections or rights to bring proceedings in their country of residence where those rights apply. These Terms do not require arbitration or waive class-action rights.

12. Changes to these Terms

We may update these Terms to reflect changes to the Service, legal requirements, or our operations. We will post the revised Terms with an updated date and provide additional notice or request agreement where required by law. Material changes apply prospectively, subject to applicable law. If you do not agree to revised Terms, stop using the Service and cancel any recurring subscription before its next renewal.

13. General terms and contact

If a provision is unenforceable, the remaining provisions remain in effect to the extent permitted by law. A delay in enforcing a provision does not waive the right to enforce it later. These Terms and any purchase terms expressly presented to you form the agreement governing your use of the Service. Our Privacy Policy separately explains how we handle personal information.

For support, billing questions, reports of misuse, or questions about these Terms, email [email protected] or use our contact form.
